WHAT IS A COMPLIANCE OFFICER ?
The Compliance Officer reports directly to the Compliance Manager and plays a crucial role in enhancing and maintaining compliance activities throughout the company. The main objective is to ensure adherence to regulations such as the Investment Advisers Act, FINRA, SEC, as well as internal company policies. This role involves engaging with various stakeholders both internally and externally, including senior management, audit firms, regulatory bodies, and investment advisors. The ideal candidate should be a proactive professional motivated by dynamic challenges within a progressive company. They should contribute value by offering strategic business solutions and effectively identifying potential risks.
Need-to-Know Overview of a Compliance Officer
1. Compliance Officer Roles and Accountabilities
- Provide overall compliance-related guidance and support to various departments and senior leaders throughout the organization
- Work with various teams across the organization to ensure that appropriate regulatory policies, procedures and controls are established and well documented
- Interpret and anticipate internal/external business challenges in order to recommend best practices for improving processes, service, and regulatory compliance
- Develop, organize and deliver training and communications on Compliance policies and procedures to ensure proper understanding of regulatory related risks and responsibilities
- Manage compliance review process for new clients and annual client due diligence
- Coordinate the monitoring, tracking, and reporting of compliance activities and testing
- Ensure that ongoing regulatory filings and compliance tasks are completed on a timely basis
- Collaborate with the business in review and compliance approval of marketing materials, and other ‘client facing’ documentation.
- Partner with the Legal team to analyze changes to regulatory requirements and proactively manage regulatory developments
- Assist in responding to regulatory inquiries, examinations, and in working with independent audit teams
- Assist with management requests, client requests, regulatory request and/or other compliance related projects, as needed
- Assist as backup and serve as mentor to other Compliance team members, as needed
- Understand and readily support established corporate business practices, policies, internal controls and procedures designed to create value or minimize risk.
2. Compliance Officer Education and Experience
- Bachelor’s degree in Business Administration, Finance or related subject preferred
- Minimum 5-7 yrs. of experience in a similar role(s) within the Compliance or related department of a middle to large investment management company or RIA
- Strong working knowledge of a broad range of investment advisory products and other financial services products
- Knowledge of GIPS compliance, or related performance specific regulations and best practices
- Advanced knowledge of the Investment Advisers Act and applicable SEC and ERISA regulations required with specific experience with advertising/sales regulations and related regulatory filings/disclosures
- Experience in working with Web IARD; attention to detail and experience in writing procedures manuals required
- Highly developed written and oral communication skills required
- Ability to apply conceptual and innovative thinking to develop creative solutions to complex problems
- Highly developed conflict resolution and negotiation skills
- Strong analytical and problem solving skills to identify and mitigate problems
- Strong organizational skills, with proven project management skills in a dynamic environment with tight deadlines
- Strong Microsoft Office skills including Excel and Word
